    I bought HP last summer during a sales (the pack at about 40 or 50€, I do not remember exactly). Three days later, they introduced true healing that made me impossible to play like before. I felt screwed, without real possibility to enjoy my HP, so I asked for a refund. D3 refused.
    I asked Google, and they refund me without any issue.

    I've always been clear with D3, telling them that about the refund, telling them that I won't totally stop playing, but greatly reducing my play time, and as they do not deserve my money anymore, they of course can take my HP back (I did not want to "steal" them, only give my money for something I think deserve it).

    And you know what?
    They of course didn't give a *** about all that. I got my refund, and never get my HP removed, nor being banned.
    But of course, I never did this on purpose to have cheap/free HP: I really went from 2-3h or more of daily play to 10 minutes one day or another.

    Those HP were useful to fully upgrade my LThor, and I never felt bad about that. Refund are ok if you use them for a valid reason, and be clear with that. D3 didn't choose to do as I want: refund me and take back my purchase, it's their choice, not mine. But if you ask for a refund, be prepared for all the consequences.

    It's not wear or loss of intrinsic value over time. It's actually the definiotion of 'value' for what was purchased in the first place: is the value of the character in the character itself, or in the utility you've had of winning matches with that character?
    If the former, then you have no basis for argument as the actual adjustments to the skills do not alter your ability to use the character casually or to have it their as a collectible trophy in your inventory. If the latter, then you have profitted substantially of the value already, which in most cases would mean D3P/Demiurge has only partially failed to live up to performance of the contract of sale and you are only elligible for a partial refund on the sum you've spent.

    (Afaik, the articles describing those type of constructs are still there in EU directives and member state implementations thereof...)

    Anytime I see people claiming "you've reaped the rewards of XForce (or insert your favorite nerfed character here)", my response would be that D3 is clearly the one who has "reaped the rewards (read: profited) from the changes made to XForce.
