His card still lists him as "Director of S.H.I.E.L.D", a title which he no longer holds after passing it on to Coulson...

  • On top of that, Fury is supposed to have handed over the reigns of S.H.I.E.L.D. to Osborn, who renames it H.A.M.M.E.R. This was all laid out in the beginning of the Dark Avengers series a few years ago.

It's like they wanted to go with Dark Reign, but wanted to pick-and-pull other characters, like Bag-Man.

The character is a representation of his skills and powers while acting as "Director of SHIELD" similar to the Black Panther covers depicting him while he was subbing for Daredevil. Black Panther would not normally be called "Man without Fear" but that was how they chose to depict him.

From your argument, none of the Marvel NOW covers should be allowed as they did not exist during the timeline.

This is like saying "Yelena fighting Natasha is a bug" because they chose to ignore the facts from the books. It isn't a bug, it is non-canonical. Making comic-book-accurateness arguments in the bug and technical issue section is going to get you nowhere.
