Malevolent Whispers stops stealing [Investigating]

I'm not really sure what makes this break down, but Malevolent Whispers will sometimes steal your opponent's creatures. If there's just ever been one creature on the board, it seems to work ok. If either side has three creatures at once, it doesn't steal and only gives it haste and +2/0. But I also played a game where both sides had 2 creatures and MW didn't work. No side ever had three at once.
Happened during Avacyn's Madness and I toyed with it a little in legacy TG.

    Had a similar issue when opponent played the card during Avacyn's Madness, so just wanted to add another case...

    Both of us had 3 creatures in play, opponent casts Malevolent Whispers (on my 3rd creature, Akoum Firebird).

    My 3rd creature got +2/+0, however opponent did not gain control, as stated in original post.

    Further, at the end of opponent's combat phase, I received a "Replace Creature" prompt for some reason.  After selecting "Not Now," my third creature was destroyed and I was left with 2 creatures.

    Hmmmmm, this makes it seem like the game is treating the creature as having changed control without actually moving the creature over.  So you "got back" a 4th creature that didn't exist, which happened to be the Firebird that did exist, so you got the "replace creature" prompt and kill you would have gotten if you were "stealing" the bird with a full board.

    Yeah, sounds right to me.  I should add I couldn't replace the Firebird with itself.

    (first time trying to add an image, hopefully it works...)
