Nick Fury The AP Cheat

I was just recently in the progress of completing the Normal - Simulation 07 node which has Nick Fury and two goons (I'm using Laken, Birdman and Red Riding Hood); I wipe out the spy first and proceed to take away Fury's health. I'm sitting there watching the enemy's AP to make sure no sneaky business is going on, Fury cast Demolition and kills Daken (that's OK). Fury now has 3 yellow, so I'm in no danger of the Avengers coming in and clipping Birdman's wings or eating Little Red Riding Hood; Next thing you know that cheater uses Avengers Assemble, like ****, he had 3 yellow, there wasn't even a cascade before hand (he had Web Bandages as the Team-up). So that near kills me, I down Fury with a match, only to then lose to the goon due to CD tiles.

TL;DR: Fury used Avengers Assemble with only three yellow AP. Has this happened to anyone else?
